Prize Draw Terms and Conditions
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ENTERING THIS COMPETITION.
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.
THE PROMOTER
The Promoter is: Kubota UK of Dormer Road, Thame, Oxfordshire OX9 3UN
THE COMPETITION
The title of the competition is Kubota 12 Days Of Christmas 2023.
THE PRIZE
The prizes are: 1x Tape Measure, 1x Toolbox, 1x Scale Model, 1x Boot Bag, 1x Wireless Charger, 1x LED Torch, 1x Kubota Rugby Shorts, 1x Thermos Bottle, 1x Scale Model, 1x Backpack, 1x pending and 1x merchandise bundle worth £200 and 12 prizes are available to be won by 12 individuals (x1 per day) who will be chosen at random.
In the event of the prize not being available for whatever reason, the Promoter reserves the right to replace the prize with an alternative prize of equal or greater value and quality.
Any and all prize related expenses, including without limitation any and all national and/or local taxes shall be the sole responsibility of the winner.
Prizes are subject to availability. Save as set out in clause 3.2, the prize is as stated with no cash alternative in whole or in part and the prize is non-transferable.
ENTRIES
The competition will run for a limited time only, opening on 11.12.2023 at 9.00am and closing on 22.12.2023 at 11.59pm (“Closing Date”). All entries must be received no later than 11.59pm on the Closing Date. Entries received after the Closing Date are automatically disqualified.
To enter this competition, you must like the post, follow the Kubota UK Instagram page and tag two friends in the comments.
Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Kubota UK.
Participants must be registered on Instagram to enter.
There is no maximum of entries per user. However, entries including the same person tagged will only be counted once. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Kubota UK. The authenticity of each account tagged will be checked.
The Promoter will not accept:
responsibility for lost competition entries, including, for example, as a result of equipment failure, Internet malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
proof of transmission as proof of receipt of entry to the competition.
By entering this competition, you are agreeing to be bound by these terms and conditions.
ELIGIBILITY
The competition is open to all residents in the UK aged 18 years or over at the date of entry, except:
employees of the Promoter or its holding or subsidiary companies;
employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or
members of the immediate families or households of 5.1.1 and 5.1.2 above.
The Promoter will not accept competition entries that are:
automatically generated by a computer;
completed by third parties or in bulk;
illegible; or
incomplete.
In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter reserves the right to verify your eligibility to enter the competition.
The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.
Competition entries cannot be returned.
WINNERS
The winner of the competition will be electronically drawn at random by the Promoter. The chosen winner is final and no correspondence or discussion will be entered into with the Promoter.
The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and county of major prize winners and, if applicable, their winning entries on Instagram stories between 12.12.2023 (“Announcement Date”) and 23.12.2023.
If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter on kubota@hroc.co.uk. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
The winner will be contacted personally by the Promoter via Instagram comment and message.
The Promoter will make all reasonable efforts to contact the winner. The winners will be notified within 2 days of the Announcement Date.
The Promoter shall have no liability for a winner’s failure to receive notices due to winners’ spam, junk e-mail or other security settings or for winners’ provision of incorrect or otherwise non-functioning contact information
If the selected winner cannot be contacted, is ineligible or fails to claim the prize within 14 days from the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.
Delivery of the prize will be within 28 days of the Announcement Date.
The Promoter does not accept any responsibility if you are not able to take up the prize.
DATA PROTECTION
If you are the winner of the competition, the Promoter may use your name, image and town or county of residence to announce the winner of this competition and for any other reasonable related promotional purposes.
Any personal data relating to competition entrants will be used in accordance with the Promoter’s privacy policy which can be found at https://kuk.kubota-eu.com/privacy-notice-en. See also condition 6.2, with regard to the announcement of winners.
LIMITATION OF LIABILITY
By entering, and insofar as is permitted by law, you agree to release and hold harmless the Promoter and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. This includes, whether caused by negligence or not, from entrant’s participation in the sweepstakes and your acceptance, possession, use, or misuse of any prize or any portion thereof:
technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software;
the unavailability or inaccessibility of any transmissions or telephone or Internet service;
unauthorised human intervention in any part of the entry process or the promotion; and
electronic or human error which may occur in the administration of the Promotion or the processing of entries.
Your statutory rights are not affected.
This competition is in no way sponsored, endorsed or administered by, or associated with Instagram. You understand that you are providing your information to the Promoter and not to Instagram.
By entering this promotion, you accept to relieve Instagram from any responsibility.
OWNERSHIP OF COMPETITION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS
The Promoter does not claim any rights of ownership in your competition entry
You agree that the Promoter may, but is not required to, make your entry available on its website at https://kuk.kubota-eu.com and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.
GENERAL
The Promoter reserves the right to hold, void, suspend, amend or cancel the competition where it becomes necessary to do so for reasons outside of the Promoter’s reasonable control.
If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
